Terms of Service

These terms govern the purchase and use of digital products offered by NTK Foundry, an Einzelunternehmen operated by Niklas Dietz ("Provider", "we"). By placing an order you agree to these terms. The provider information is published in the Impressum.

1. Scope

These terms apply to contracts concluded via ntkfoundry.com between the provider and the customer regarding digital goods (Unity plugins and related materials).

2. Conclusion of contract

Product presentations on the website are non-binding invitations to purchase. The contract is concluded once we send a license key by email after successful payment processing through Paddle (Merchant of Record).

3. Prices and payment

Prices include applicable VAT. Payment is processed by Paddle.com Market Limited as Merchant of Record. Paddle handles invoicing, tax collection, and refunds.

4. Delivery and license

Upon successful payment, a license key is delivered by email and is also visible in the customer's dashboard. Each license is non-transferable and grants the customer a perpetual, non-exclusive, non-sublicensable right to use the purchased plugin within their own commercial and non-commercial Unity projects. License keys may be activated on up to three (3) machines simultaneously.

5. Right of withdrawal (consumers, EU)

Consumers in the EU have a 14-day right of withdrawal. By starting the download or activating the license before the withdrawal period ends, the consumer expressly agrees that the right of withdrawal expires upon commencement of performance (§ 356 Abs. 5 BGB).

6. Refunds

Refund requests are handled by Paddle in accordance with their refund policy. Contact us first at niklas.dietz@gmx.de so we can assist before opening a Paddle dispute.

7. Warranty

Statutory warranty rights apply. Plugins are provided "as is" with reasonable effort to keep them compatible with current Unity LTS releases. We do not guarantee uninterrupted operation or compatibility with every third-party tool.

8. Limitation of liability

Liability for slight negligence is limited to typical, foreseeable damages. Liability for intent and gross negligence as well as for damages resulting from injury to life, body, or health remains unaffected. We are not liable for lost profits or indirect damages arising from use of the plugins.

9. Resale and redistribution

Resale, redistribution, or sublicensing of the plugin source code or compiled binaries outside the customer's own projects is prohibited.

10. Changes to these terms

We may update these terms for future purchases. The version effective at the time of purchase remains valid for that purchase.

11. Governing law and jurisdiction

German law applies. For consumers, mandatory consumer-protection provisions of their country of residence remain unaffected. Place of jurisdiction for merchants is the registered seat of the provider.
